These terms are an agreement between you and [COMPANY NAME, LLC] ("we," "us") for your use of Brain Weather. By creating an account, you agree to them.
1. What Brain Weather is, and isn't
Brain Weather is a self-tracking journal for general wellness and self-awareness. It is not medical care, therapy, or a medical device. It does not diagnose, treat, cure, prevent or manage any condition, and its ratings, summaries and pattern notes are not clinical assessments. Using Brain Weather does not create a clinician–client relationship with anyone, including the app's creator. Talk with a qualified professional about your health, and never delay or change care, including medication, because of something in the app.
Brain Weather is not a crisis service. If you are in danger or thinking about harming yourself, call or text 988 (US), call 911, or go to the nearest emergency room.
2. AI features
Sort it for me and Find patterns use artificial intelligence. AI can misunderstand or be wrong. Review every rating before you save it. You are responsible for what you save.
3. Eligibility and your account
You must be 18 or older. Keep access to your email account secure, since sign-in links are sent there. You're responsible for activity on your account.
4. Subscription, free trial and cancellation
- Brain Weather's AI features require a paid subscription. New subscribers may receive a free trial of [7] days.
- Unless you cancel before the trial ends, your subscription starts automatically and renews each [month] at the then-current price until you cancel. Your payment method is charged at the start of each billing period.
- Cancel anytime in the app under Account → Manage subscription. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- [REFUND POLICY: e.g., "Payments are non-refundable except where required by law." ATTORNEY: confirm compliance with automatic-renewal laws in the states where you sell, and with the FTC's rules on negative-option billing.]
- We'll give you advance notice of any price change.
- If you subscribe through Apple or Google in the future, their billing and refund terms apply to that purchase.
5. Your content
You own your journal entries. You give us a limited license to store, process and display them only to provide the service to you, including sending entry text to our AI provider when you use the AI features. See the Privacy Policy.
6. Acceptable use
Don't misuse the service: no attempts to access other people's data, disrupt the service, reverse-engineer it, resell it, or use it for anything unlawful.
7. Changes and ending the service
We may update the app and these terms. For material changes, we'll notify you in advance. You can stop using Brain Weather and delete your account at any time. We may suspend accounts that violate these terms.
8. Disclaimers
The service is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. [ATTORNEY: review.]
10. Governing law and disputes
These terms are governed by Texas law. [ATTORNEY: choose venue, and decide whether to include informal dispute resolution, arbitration, and a class-action waiver.]
